As distinct from the legislation of many foreign countries, the Russian subsoil legislation and land legislation define the areas of the subsoil and land plots as independent legal objects. The article is devoted to the problem of regulatory issues arising between the right holders to use the subsoil and the owners of the land plots located above them. The disputes emerge due to the absence of a statutory procedure for granting rights to land located above the subsoil for the purposes of subsoil use. The article presents the results of the analysis of the regulatory support of land relations in the development of mineral deposits. The analysis is supported by a practical example of the process of forming a site for the development of a building sand deposit. The interrelation of research and practical experience allowed to reasonably formulating proposals for improving legislation in the field of land relations and subsoil use.
